Terms of Service

Welcome to Obscurify.ai. These terms are an agreement between you and CryptoTalks LLC, which operates Obscurify.ai ("Obscurify", "we", "us"). By using our services, you agree to these terms. Please read them carefully.

1. Service Description

Obscurify.ai provides privacy-focused access to AI language models. We act as an intermediary between you and various AI providers, allowing you to use these services without directly exposing your identity to them.

Some models we offer have fewer built-in content filters than mainstream AI services. These terms apply to every model, whatever its filters allow.

2. Eligibility

You must be at least 18 years old, and old enough to enter a contract where you live, to use Obscurify. If you use Obscurify for an organization, you agree to these terms on its behalf.

3. Account Registration

You can chat as a guest without an account. Paid models and the API require an account, which is identified only by a random 16-digit account number. We store only a scrambled copy of the number and cannot recover it, so a lost number means a lost account and balance. Accounts created with a username and password must switch to their account number; password sign-in is being retired. You are responsible for:

• Keeping your account number and API key safe
• All activity that occurs under your account

4. Deposits and Account Balance

Our service operates on a prepaid credit system. You add funds by buying vouchers and redeeming them to your account balance, which then pays for AI model usage. Vouchers are blind-signed, so we cannot link a voucher to the payment that bought it.

An unredeemed voucher works like a gift card: anyone with its code can redeem it once, and we cannot replace a lost or stolen voucher. A redeemed voucher counts as a deposit from the time it is redeemed.

• Vouchers and balances can only be spent on Obscurify services. They cannot be exchanged for cash, cryptocurrency or anything else, and we never pay them out except as refunds required by law
• Deposits are non-refundable except where required by law
• Account balances cannot be transferred to other users
• Do not buy, sell or pass on vouchers as a way to move money
• Starter credit given to new accounts is promotional: it is not a deposit, has no cash value, and cannot be refunded or withdrawn. We may change or end it at any time, and give at most one per person
• We reserve the right to suspend accounts with suspicious activity

5. Plans

We offer prepaid monthly plans with different features and pricing. A plan's fee is charged from your account balance when you choose it and again each month. If your balance can't cover the next month, your account moves to Pay As You Go. There are no card subscriptions.

You can instead prepay a plan for twelve months at a discount. The included usage is still given monthly and doesn't carry over. If you are on a paid plan already, the twelve months include the month you are in, and what you paid for that month comes off the price. A yearly plan doesn't renew as a year: when it ends, the plan renews monthly at the monthly price while your balance covers it. If you leave a yearly plan early, the price you paid, less the monthly price for each month started, returns to your account balance. That amount is balance, not cash (see section 4).

6. Acceptable Use

You agree not to use our service to:

• Violate any applicable laws or regulations
• Create, request or share sexual content involving minors, including fictional, drawn or AI-generated content (child sexual abuse material, or CSAM)
• Create sexual or intimate images of a real person without their consent
• Get help making or using biological, chemical, nuclear or radiological weapons, or explosives meant to hurt people
• Write or spread malware, or break into computers, accounts or networks you are not authorized to access
• Commit fraud, run scams or phishing, or impersonate real people to deceive others
• Stalk, threaten or dox anyone
• Generate content that promotes violence, harassment, or discrimination
• Launder money, evade sanctions or fund crimes, including through vouchers
• Attempt to circumvent usage limits or security measures
• Resell or commercially redistribute access to our service without authorization

We don't read your chats. If we learn of a violation, for example through a report, a legal request or one of our AI providers, we may suspend or close the account involved. Report abuse to contact@obscurify.ai.

7. Your Content and AI Output

You own your prompts and the output you receive. You are responsible for what you send and for how you use the output. AI output can be wrong, offensive or unsafe: check it yourself, and do not rely on it for medical, legal, financial or safety decisions.

8. Privacy

We are committed to protecting your privacy. Conversations are held in memory for up to 1 hour for performance reasons, then permanently deleted; they are never written to disk. We do not share your personal information with AI providers. For more details, see our Privacy Policy.

9. Legal Requests and Reporting

We comply with valid legal process that applies to us, such as subpoenas, court orders and warrants. Because conversations are held in memory for up to 1 hour for performance reasons, then permanently deleted, and accounts are only a number, we usually have little to provide; our Privacy Policy lists what we keep. When the law requires it, we preserve records we already hold.

As US law requires, we report apparent child sexual abuse material that we learn of to the National Center for Missing & Exploited Children (NCMEC).

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance that temporarily affects availability
• Modify or discontinue features with reasonable notice
• Limit access during periods of high demand

11. Disclaimer and Limitation of Liability

Obscurify.ai is provided "as is" and "as available", without warranties of any kind, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We are not liable for:

• AI model outputs or their accuracy
• What you or anyone else does with the service or its output
• Indirect, incidental, special, punitive or consequential damages
• Loss of data or business interruption
• Actions taken by third-party AI providers

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US$50. Some places don't allow some of these limits; there, they apply as far as the law allows.

12. Indemnity

You agree to defend and reimburse CryptoTalks LLC and its owners, staff and contractors for any claims, losses and costs, including reasonable legal fees, that arise from your use of the service, your prompts, or your breach of these terms or the law.

13. Account Termination

We may suspend or terminate accounts that violate these terms or are involved in payment fraud or chargebacks (see section 4), or when the law requires us to. We don't close accounts for any other reason. If we close an account for violating these terms, its remaining balance is forfeited. You may close your account at any time, but remaining balances are non-refundable per our deposit policy.

14. Governing Law and Disputes

These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-law rules. Any dispute must be brought in the state courts of Montgomery County, Maryland or the United States District Court for the District of Maryland, and you and we consent to their jurisdiction. Either of us may instead bring a claim in small claims court. As far as the law allows, claims may only be brought individually, not as part of a class or representative action.

15. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will announce significant changes on the site.

16. General

These terms, together with our Privacy Policy (and, for affiliates, the Affiliate Terms), are the whole agreement between you and us about the service. If a court finds part of them unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later.
